Bankruptcy reports

Lawyers of the insolvency department of Hoens & Souren Keereweer are frequently appointed as receivers and act regularly as administrators in suspension of payment cases.

 

In bankruptcies the receivers issue public reports with the following frequency: the first report within one month, the second report within three months, and after that a report every six months. These reports are deposited in the registry of the court.

Hoens & Souren Keereweer offers interested parties an opportunity to view the interim public reports on this website. That goes in principle for the new reports issued since 1 November 2005. No rights can be derived from the data published on the website.

The reports published in this way are mentioned below. They are sorted in alphabetical order, where the name of the bankrupt (legal) person, rather than the company name, is determining.

 

Notification to creditors

Unlike the procedure to which you may be used, we 'only' acknowledge receipt of the filing of your claim by returning a copy of your message, signed for receipt (compare: article 110, section 2, of the Bankruptcy Act). Your claim is placed on a list only in the event that payments to the creditors in the bankruptcy are made or in the event that special circumstances so require.

 

The forecast of the receiver about the settlement of the bankruptcy can be found in paragraph 8.7 of the public report (paragraph XI in the case of reports with the 'old layout'). It might be possible for you to claim back turnover tax on the basis of this forecast.

The first public report is usually published approximately one month after the bankruptcy has been pronounced and is posted on the website.
